Assignment Question: Luna is a skilled migrant in New Zealand with lawful immigration status. After 25 September 2023, Luna, the Hairdresser, submitted a Skilled Migrant Residence application to Immigration New Zealand ("INZ"). She was applying as a Hairdresser working for the Accredited Employer Hairdresser Inc (please do not include details of Accreditation in your assessment response). A skilled migrant residence application requires that the applicant demonstrate that they are suitably qualified for the position on which they are basing their residence application.
INZ determines that a person is suitably qualified by consulting the ANZSCO database and relevant immigration instructions (please do not assess Luna's eligibility as a hairdresser under the ANZSCO database or the relevant immigration instructions). Luna was relying on her previous work experience at Coloured Hair Ltd as evidence that she was suitably qualified to work as a Hairdresser in New Zealand.
Luna submitted a letter from Coloured Hair Ltd as evidence of her work experience. This letter was on Coloured Hair Ltd’s official letterhead and recorded her start and end dates and duties. The letter was grammatically correct, dated correctly and signed by her former manager, Katie Smith. The details in the letter demonstrate that Luna has enough relevant work experience to be considered a hairdresser by the ANZSCO database and relevant immigration instructions.
While an INZ officer processed Luna's visa application, they randomly called Katie Smith to verify that Luna had worked at Coloured Hair Ltd as a hairdresser (clarification: the INZ officer did not organise a time with Katie to call her). The INZ officer called when Coloured Hair Ltd was very busy. The INZ officer asked Katie how much Luna had been paid, how long Luna had worked for Coloured Hair Ltd and if Luna had had a pay rise when she worked there. Katie tried her best to answer the questions but had to tell the INZ officer that she didn't know because she didn't have the information in front of her. 2 When the INZ officer ended the call, they decided that the employer was not credible and that Katie Smith was lying. They concluded that Luna had not worked at Coloured Hair Ltd and had submitted false and misleading information.
